Welcome to Kay Florist (“we,” “us,” or “our”). By accessing our website, placing an order, or booking event services, you agree to be bound by the following Terms of Service (“Terms”). If you do not agree, please do not use our services.


1. Use of Website

You agree to use our website for lawful purposes only. We reserve the right to refuse service, cancel orders, or deny access at our discretion.


2. Products & Services

Kay Florist provides:

  • Fresh floral arrangements and plants

  • Flower subscriptions

  • Local delivery services

  • Event floral design services, including but not limited to:

    • Corporate events

    • Weddings

    • Funerals and memorial services

    • Showers, parties, and special occasions

All products and services are subject to availability.

Photos displayed on our website are for design inspiration only. Exact flowers, colors, and containers may vary based on seasonal availability and market conditions.


3. Local Delivery Only

Kay Florist provides local delivery only within our designated service area.

We are not responsible for:

  • Orders placed outside our delivery zone

  • Delays caused by incorrect delivery information

  • Recipient unavailability or refusal

Delivery dates and times are estimated, not guaranteed.


4. Orders & Payments

All prices are listed in U.S. dollars unless otherwise stated.

By placing an order or booking services, you confirm that:

  • You are authorized to use the payment method provided

  • All billing and delivery information is accurate

Payments are processed securely through third-party providers. We do not store full payment card details.


5. Subscriptions & Recurring Billing

By purchasing a subscription, you authorize recurring charges according to the selected delivery frequency.

Subscription Rules

  • Subscriptions may be paused, skipped, or canceled prior to the billing cut-off

  • Changes must be made at least 72 hours before the scheduled billing date

  • Subscription deliveries already processed are non-refundable

  • Skipped deliveries are not charged

Subscriptions remain active until canceled by the customer.


6. Event Floral Services

Consultations & Proposals

Event services may require a consultation and custom proposal. Pricing is based on design scope, flower availability, labor, delivery, setup, and breakdown requirements.

Deposits & Payments

  • A non-refundable deposit is required to secure event dates

  • Remaining balances must be paid by the deadline outlined in your event agreement

  • Failure to submit payment may result in cancellation of services

Changes & Cancellations

  • Event changes must be requested in writing

  • Significant changes close to the event date may not be accommodated

  • Deposits and payments are non-refundable once flowers are ordered or preparation has begun

Substitutions

Due to seasonal and market availability, substitutions may be required. We will maintain the agreed-upon style, color palette, and value whenever possible.


7. Holiday Orders

Due to high demand, special rules apply for major floral holidays, including but not limited to:

  • Valentine’s Day

  • Mother’s Day

  • Easter

  • Administrative Professionals’ Day

  • Thanksgiving

  • Christmas

Holiday orders:

  • Must be placed by posted cut-off dates

  • Are final once processing begins

  • Cannot be canceled, modified, or refunded after cut-off

Holiday subscription deliveries will proceed automatically unless paused or skipped before billing cut-off.


8. Cancellations & Refunds

One-Time Orders

  • Must be canceled at least 48 hours prior to delivery

  • Orders canceled after this window may not be eligible for a refund

Perishable Products

Flowers and plants are perishable and cannot be returned once delivered.

Refunds or replacements may be considered if:

  • We are notified within 24 hours of delivery, and

  • Photo documentation is provided


9. Intellectual Property

All content on this website—including text, images, logos, and designs—is the property of Kay Florist and may not be copied, reproduced, or used without written permission.


10. Limitation of Liability

To the fullest extent permitted by law, Kay Florist is not liable for:

  • Indirect or consequential damages

  • Delivery delays beyond our control

  • Allergic reactions to flowers or plants

Our maximum liability is limited to the total amount paid for the order or service.


11. Privacy

Your use of our website and services is governed by our Privacy Policy.


12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.


13. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our website or services constitutes acceptance of any changes.
